Terms of Use
These Terms of Use (“Terms”) are set by NextGen Shopping, LLC, a System1, Inc. company (“DealFeed”, “we”, “us” or “our”). These Terms and our Privacy Policy, which is incorporated by reference, govern your use of the dealfeed.com website and its subdomains, the DealFeed mobile apps for iOS and Android, and any related services (collectively, the “Services”).
By using the Services, you agree to these Terms and to all applicable laws, and you are responsible for complying with local laws that apply to you. If you do not agree, do not use the Services.
Arbitration. These Terms include a binding arbitration provision and a waiver of the right to bring a class action or to go to court. See Dispute resolution below.
Accessibility. If you have trouble accessing these Terms or the Services, contact us at hello@mail.dealfeed.com. We use third-party tools to review the accessibility of the Services and work to improve it.
What DealFeed is
DealFeed finds deals on products sold by online retailers and shows them in a feed, with prices, discounts, promo codes where available, and a short explanation of why we think each one is a deal. DealFeed does not sell anything. When you choose a deal, we send you to the retailer’s site, and any purchase is between you and that retailer, under the retailer’s terms.
Affiliate disclosure
We may earn a commission when you buy through links on DealFeed, at no extra cost to you. As an Amazon Associate we earn from qualifying purchases. We also participate in other retailers’ affiliate programs and affiliate networks. Commissions do not change the price you pay.
Deals, prices and promo codes
Retailers change prices, stock and promotions often and without notice. We check deals and remove ones we find have ended, but we do not guarantee that any price, discount, promo code, availability, reference (“was”) price, deal score or description shown on DealFeed is accurate, complete, current or error-free. The price and terms shown on the retailer’s site when you buy are the ones that apply. Promo codes may expire or carry retailer restrictions. Please confirm the details on the retailer’s site before you buy.
Your account
You can browse DealFeed without an account. Saving deals creates an anonymous account on your device, and you can sign in with an email code, Google or Apple to keep your saves across devices. You must be at least 16 years old to use the Services. Your account is for your personal use only; do not share it or transfer it to anyone else. You are responsible for activity on your account and for keeping access to your email and sign-in providers secure.
You can delete your account at any time from the Account page in the app or on dealfeed.com. We may suspend or close accounts, or limit access to the Services, at any time, with or without notice, including for violations of these Terms or suspected fraud or abuse.
Invites
Signed-in users may receive an invite code to share with friends. Invite codes are for personal, non-commercial sharing. We may change, limit or end the invite program, and any benefits tied to it, at any time. We may void invites we believe were obtained through fraud, self-referral, spam or automated means.
Notifications and email
If you allow them, we send push notifications and emails about deals, price drops on deals you saved, and your account. You can turn notifications off in your device settings or in the app, and unsubscribe from marketing email at any time. Sign-in codes are sent only when you request them.
Acceptable use
The Services are for your personal, non-commercial use. Except as the Services expressly allow, you agree not to copy, download, scrape, sell, license, modify, distribute, republish or create derivative works from any content, code or data on the Services. You may not systematically retrieve data or content from the Services to build a collection, database or directory; use bots, scripts or other automated means to access the Services; interfere with or disrupt the Services; attempt to access accounts or systems without authorization; or use the Services for anything unlawful.
Feedback and submissions
If you send us feedback, including reports on whether a deal worked, suggestions or ideas, you give us the right to use it for any purpose without payment or obligation to you. Please do not send us confidential information.
Intellectual property
The Services, including their design, text, graphics, software and the DealFeed name and logo, are owned by us or our licensors and are protected by copyright, trademark and other laws. Product names, images and trademarks shown in deals belong to their respective owners, and their appearance on DealFeed does not imply endorsement.
Third-party sites
The Services link to retailers and other third-party sites that we do not control. We are not responsible for their content, products, services, prices, promotions, availability, policies or practices, including how they collect and use your information. Please read their terms and policies, including those on sales, returns, warranties and privacy, before you buy. Your use of third-party sites is at your own risk, and a link does not mean we sponsor or endorse that site.
Disclaimer and limitation of liability
THE SERVICES, INCLUDING ALL CONTENT MADE AVAILABLE ON OR THROUGH THEM, ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING NON-INFRINGEMENT, TITLE, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SERVICES WILL BE SECURE, UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SERVICES MAY CONTAIN TYPOGRAPHICAL OR PRICING ERRORS, AND WE ARE NOT BOUND BY THEM.
IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542 IN CONNECTION WITH THE FOREGOING, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
IN NO EVENT WILL DEALFEED BE LIABLE FOR (I) ANY INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES (INCLUDING LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICES, OR ANY INFORMATION OR TRANSACTIONS PROVIDED THROUGH THEM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS OR OTHER INACCURACIES IN THE SERVICES, INCLUDING DEAL PRICES AND AVAILABILITY. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU; IN THOSE STATES OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. IN NO EVENT WILL DEALFEED BE LIABLE TO YOU FOR DIRECT DAMAGES IN EXCESS OF $100 (USD).
Indemnification
You agree to defend, indemnify and hold harmless DealFeed, NextGen Shopping, LLC, System1, Inc., and their parents, subsidiaries, affiliates, licensors and service providers, and each of their employees, contractors, officers, directors and agents, from all liabilities, claims, losses, damages, costs and expenses, including attorneys’ fees, arising from (a) your use of the Services; (b) your breach of these Terms; or (c) your violation of any third party’s rights. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.
Changes to the Services and these Terms
We may change, suspend or discontinue any part of the Services at any time. We may revise these Terms by posting an updated version here; the “Last updated” date shows when they last changed. By continuing to use the Services after a change, you agree to the revised Terms.
Dispute resolution
These Terms are governed by the laws of the State of New York and of the United States, without regard to conflict-of-law principles. If a dispute arises, the party raising it must first contact the other in writing, including by email, describing the dispute in reasonable detail and the remedy sought. Notices to us must be sent to hello@mail.dealfeed.com with “DISPUTE NOTICE” in the subject. We may send notices to the email address on your account. Both parties will try in good faith to resolve the dispute before starting arbitration.
Arbitration
ANY DISPUTE BETWEEN YOU AND US WILL BE RESOLVED BY BINDING ARBITRATION, AND YOU GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under these Terms, except for matters within the jurisdiction of your local small claims court. A neutral arbitrator, not a judge or jury, will decide your rights. Any dispute arising out of or relating to these Terms or the Services will be resolved by mandatory, binding arbitration administered by JAMS under its rules and Consumer Arbitration Minimum Standards, at the request of either party, as follows:
- Place. Unless you choose to arbitrate by telephone or written submission, any in-person hearing will be held at a JAMS facility in your area or in New York, New York.
- Rules. Claims of $5,000 or less are arbitrated under JAMS’ Streamlined Arbitration Rules & Procedures, and larger claims under JAMS’ Comprehensive Arbitration Rules & Procedures, before a single neutral arbitrator who may allow reasonable discovery consistent with the purpose of arbitration.
- Award. The arbitrator will issue a written decision with findings of fact and conclusions of law. The award is final and binding, and judgment on it may be entered in any court with jurisdiction.
- Costs. You are responsible for the JAMS filing fee to start arbitration. To the extent JAMS procedures allow, each party bears its own costs and an equal share of the arbitrator’s and administrative fees, and we will pay any additional costs that JAMS procedures require us to pay.
- Interim relief. The Federal Arbitration Act applies to these Terms. Either party may seek interim or provisional relief from a court to protect its rights or property while arbitration is pending.
Class-action waiver
Any arbitration, claim or proceeding between you and us will be conducted individually, and not as a class, mass, consolidated or representative action. The arbitrator may not award class-wide relief or combine claims. If for any reason a claim proceeds in court rather than arbitration, each party waives any right to a jury trial. Any claim that all or part of this waiver is unenforceable may be decided only by a court.
General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the Services.
